HOPEWELL, Va. –

A judge today ordered the release of a Marine Corps veteran being detained as a psychiatric patient after concerns over his Facebook postings.

After an hourlong hearing, Circuit Judge W. Allan Sharrett said an involuntary commitment petition issued against Brandon J. Raub was invalid because it contained no allegation or basis to holding him.

“The petition is so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy,” said the release order signed by the judge and sought by lawyers Anthony F. Troy and Brian D. Fowler.

Sharrett said that he was shocked by the failure of a magistrate to not include in the order any grounds for holding Raub, a Chesterfield resident who was transferred from John Randolph Hospital in Hopewell to the Salem Veterans Affairs Medical Center.

Cathleen Thomas, Raub’s mother, said after the hearing that as soon as an order is entered by the court, she will head to Salem to get her son.

“This is phenomenal.” she said. “This could have happened to anyone. We’re not about allowing wrongs like this to take place.

“This has never been about anything but freedom of speech…. We’re going to continue to post on Facebook.”

Thomas said her son is a “true patriot” who gave up military benefits for a back injury so the money could go to another veteran.

Raub, 26, who served in Iraq and Afghanistan, was taken into custody last Thursday after the Secret Service, FBI and Chesterfield Police arrived….

Raub’s lawyer petitions court for illegal detention

The attorney for the former Marine who was forced into a psychiatric ward for anti-government Facebook postings filed a petition Wednesday claiming law enforcement did not uphold Virginia laws for involuntary detentions.

“The law requires that within four hours of detaining someone, you have to have a magistrate write a petition for a temporary restraining order,” said John Whitehead, an attorney with the Rutherford Institute, the Virginia-based civil rights firm that is defending the ex-Marine. “They didn’t do that. That didn’t happen.”

Brandon Raub, 26, was taken into custody at his Richmond, Va., home Thursday, Aug. 16, by FBI and Secret Service agents and Chesterfield County Police. He has yet to be charged with a crime; he was handcuffed and placed in the back of a police vehicle and transported to the police department. From there, he was admitted to the John Randolph Medical Facility in Hopewell for a psychiatric evaluation.

His crime?

Officially, nothing.

“They did not charge him with anything,” Mr. Whitehead said in an interview Wednesday with Times247.com. “He was in his underwear, in his living room, he sees a group of police, FBI agents walking up, he talks with them, he’s asked about some Facebook postings, they handcuff him.”

The Facebook postings — the biggest clue so far to the reasons for his detention — were part of a private chat, inaccessible without an invitation, and included anti-government sentiments and warnings of revolution.

“This was a closed group, not public, not a posting on a wall,” said Cathleen Thomas, Mr. Raub’s mother, in a Wednesday morning interview. “They had to hack in to it to see it, then they took the comments out of context. But agree with him or not, agree with his comments or not, the bigger question is, why is the government checking on postings in the first place? The point is, he has a right to free speech.”

Questions

Released? We will see it when we see it, but even then, will he be thoroughly free? Or, will he be monitored and surveilled?

Can he confidently account for all that happened to him while incarcerated? Is he in possession of all, clear memories he should have of it?

Can we be sure for a fact that no human programming occurred, our (treasonous, Global Governance 2025) “Intelligence Community” being what it has steadily become, under a transnational influence attempting to inflict un-American control over our nation and practicing at least some of what Raub has mentioned in Facebook?

What about the Facebook personal espionage done by our DHS upon Brandon and upon us all? And if that is going on in our “private” Facebook pages, what about other social media, bulletin boards, other Web site visits, our emails, and our telephone conversations?

And who is next? Or, who else is being held in this way, even now?
